Mit einem Fahrrad kannst Du es gar nicht vergleichen. Mal davon abgessehen, daß es im Bürgerlichen Gesetzbuch Sonderreglungen im Bezug auf einem Fahrrad gibt, so kann man ein Fahrrad als ganzes veräußern. Sein Urheberrecht kann man nicht veräußern.
Wenn Du ein Programm schreibst und dieses über das Internet verbreitest ohne irgendwas dabei zu sagen, dann gehe ich erst einmal davon aus, dass ich dieses Programm zumindest nutzen darf! Wie es mit Änderungen aussieht, das ist dann

ein anderes Thema. Änderungen weitergeben auf jeden fall nicht, aber darf ich Dein produkt verändern? Zum Teil ist dies vielleicht notwendig: Wenn z.B. eine Config-Datei bestandteil deines Produktes ist.
Aber ich bin kein Jurist und ich denke, dass da auch erst einmal ein Grundsatzurteil ausstehen würde.
Da wird es kaum ein Grundsatzurteil zu geben, da es auf dem genauen Wortlaut ankommt. Jedes anders gesetztes Komma kann da schon was anderes bedeuten.
