<snip> Pity that the Microsoft statement attached to the letter simply reinforces the whole reason Microsoft insisted on including the patent issue. How many years before Microsoft can simply cash in their claims? Surely people should AGREE the terms before signing anything?

What about the word from the street that Novell caught M$ with its pants down with patented OSS code in its stuff? You discount that automatically just because you choose to? M$ actually said this: "Microsoft and Novell have agreed to disagree on whether certain open source offerings infringe Microsoft patents and whether certain Microsoft offerings infringe Novell patents." I guess M$ customers must be wondering just how long it will be before the evil Novell and the rest of the open-source community come after them. But that is just FUD, I guess -- unlike Balmer's pronouncements, which surely must be true! True enough, at least, to frighten off folks like you. I'll see your M$ legal department, and raise with the combined legal departments of IBM and DaimlerChrysler.
