IANAL but, Per the GPL, source has to be included, or available upon request for the cost of duplication. It is only non-GPLed code (i.e. like Yast) where anyone can restrict source access. If your curious about source availability, the GPL is very strict. Internal changes for internal use can be proprietary, but once you ship the executable to external users, you MUST provide access to the source under its own GPL license. BTW: In my opinion, the most significant single achievement of the OpenSource effort is the GPL and its acceptance.

Well it depends on what you mean. The parts of software that make the product are available on the net like kernel, dhcp, glibc etc...

You have to *buy* the product which then you will also have the sources and the patches available. The product is the mix of the packages integrated with an installer and an application to use various parts of the system for management (YaST).
