I think the best is to turn off default, as I said before many times opt-in is the expected behaviour not opt-out.

I believe you could have missed this quite easily. I've gone through upgrades on three separate machines, each with multiple user accounts, and I've always noticed this message, but it isn't necessarily obvious. You could check quite easily by closing Firefox, renaming your Firefox profile at /.mozilla/firefox/profiles.ini, restarting Firefox and seeing what messages pop up on the first couple of occasions (I don't recall if it's the very first time opening the app or later). In the same way that you receive a message in the status bar at the top or bottom of the browser window informing you of your rights, you might see another 'Improve Firefox' message along the lines of 'Mozilla sends information to help blah blah, would you like to enable...' and a button to accept, which you might have clicked without thinking just to hide the message / panel.
