Just for your information from someone who has heavily participated in those discussions in the past: The trademark protection was _NOT_ the reason the idea of an openSUSE foundation was discarded. Not in any way. There were discussions with SUSE about the trademarks and if handling them in a foundation would be feasible but those discussions never reached a conclusion. The idea of the foundation was discarded because after months and months of very detailed discussions the amount of benefits such a foundation could bring to the openSUSE project was deemed to be too small for all the organizational work one would have to do to setup right. That of course doesn't mean that someone shouldn't do it anyway :-) It was just a decision of those people involved at that time...
