I have a few questions Jos and then I'll get back to you about what you asked me,if we create a distribution out of SUSE Studio is anyone having commercial rights for that product and who is that? Its creator or Novell? What is it's license? Isn't that product a FOSS Product? Please let me know because we are a few steps behind on making a deal and I would like to be sure on what I am talking about to others, their concern is that none can have commercial rights and that the product(distribution) is free for anyone. One thing we should keep in mind is legal and license issue. Whether your appliance is a FOSS product or not depends on the licenses of the software which you adopt. If all the packages in it are FOSS applications, your appliance will be a FOSS product. But once you include proprietary software which cannot be freely redistributed in it, you won't be able to distribute it. It is technically viable to create appliances with commercial applications and 'gray zone' software such as multimedia codecs on SUSE Studio, but whether we can distribute such appliances or not is another matter. At least, such appliances shouldn't be distributed under the name of (open)SUSE.
