If the latest official SUSE rpm contains one, and you take their spec as the base to build the current version (with adequate adjustments), you will have to take special measures to prevent rpmbuild from including them! It's not rocket science.
I highly recommend you to look into: /usr/share/doc/packages/rpm/RPM-HOWTO/index.html

Thanks for the info, i'll check that once i get to the office, so i build my own rpm packages, just don't want to lose the init scripts and other customizations that one gets with the distro's supplied packages, don't even mentioning the updates... And sorry for the top posting, it was my phone/gmail combination's fault. CI.-
