Are they (AMD/nVidia) allowed to use KMS in closed source drivers?
I would imagine that the KMS code has the same license as the Linux kernel itself? And surely they use other parts of the Linux kernel. Why would KMS be any different? I suspect is has more to do with not having to maintain as much Linux-specific code in the drivers.
