After that I can find the fail2ban-server process using ps, but 'rcfail2ban status' reports that it is unused. Not nice, but does not hurt as long as it is running. The real problem occurs if I let fail2ban restart. 'rcfail2ban restart' reports that is was restarted successfully. But ps says there is no server process. I think, the bug in the init script is that we define FAIL2BAN_BIN=/usr/bin/fail2ban-client. This is OK for starting and stopping the service. But when we check for the status with '/sbin/checkproc $FAIL2BAN_BIN', the client process is never running, of course. Instead we should call checkproc on the fail2ban-server process. Which package version are you using? I believe all these problems were fixed by the last update (fail2ban-0.8.4-3.1.noarch).

http://download.opensuse.org/repositories/security/openSUSE_11.2/noarch/
