Wrong.

The driver is connected to the kernel via a module or two, which are in fact, "kernel modules". The proprietary and binary only driver uses an open source kernel module to connect to it.

This is, somehow, linking against the kernel, and distributing such a module in binary form is against the kernel license, like it or not.
