No, it doesnt matter if they are packaged separately or not, kernel modules
are always derived work of the linux kernel, hence, they **must** be
released under GPLv2 o compatible licenses.

Never the less, this issue is not as clear cut as you make it out to be.
In the opinion of the kernel developers it might be a derivitive work but
