My understanding is that for AR5 they continued to focus on improving the 20th century modeling and basically ignored the post 2000 realities because they haven't yet figured out the forcings that would cause a pause this long. Further the claim is they are still getting a handle on the recent volcano and other forcing data, so they don't want to use that period before the related forcing information stabilizes.

Given that the satellite instrument record is by far the best, their ignoring the last 10 years of only a 35 year satellite record is clearly negligence. My only question is if it is criminal negligence.

Obtaining money on the basis of false statements is fraud. Colluding with others (politicians) to raise more tax moneys, on the basis of false statements is conspiracy to commit fraud. They, and all of the politicians advocating a "carbon tax" ARE guilty of attempted fraud.
