Every software is copyrighted! And the code was open, it just wasn't BSD or GPL but it's own license. The only restriction it had, was that you couldn't use it in another distribution without explicit permission. So no, the stall had nothing to do with it but rather with a lack of experienced programmers that knew the innards of YaST.
