This sounds as if there is still an instance of Firefox running when it restarts, or else there is still a lock file in the .mozilla/user/profile directory.
No, the reason for the session restore comes up is that Firefox always thinks it crashed if it's terminated via a TERM signal. The complete shutdown process is not used if killed via SIGTERM.
