Siegbert, there are some kernel developers that do considers binary only drivers a violation of the GPL. Just googling around found me the following: http://kororaa.org/index.php?entry=entry060512-160752 We at Novell have decided to respect the view of the kernel developers as owner of it. It might be that you're right and there's no violation - or perhaps none for a specific module but some for other modules, or you're wrong.
