Yes, it's legal. They are selling burnt copies (CDR) without documentation. You won't get from them what you would get from buying directly from SuSE or a retail outlet like amazon.
Stay safe, and put your money where it's deserved by buying directly from SuSE (novell) or a retail outlet like amazon.
There's no problem with them copying the GPL stuff. However, I believe there's some non-GPL things, which might not be "copyable". Another issue, is copyrights of the SuSE name etc. Even if all the software on the disks is GPL, the SuSE name isn't.
