By Graeme Wearden and Dietmar Mueller Linux company SuSE will have to temporarily stop distributing copies of its software in Germany, following legal action on Tuesday. * Christian Egle, a spokesman for Nuremberg-based SuSE Linux, told ZDNet Germany that the injunction specifically prevents the company from distributing new copies of its SuSE Linux software. * A SuSE spokesperson in the UK explained that the case, brought by a plaintiff who is believed to hold the copyright on a program called Crayon, concerns potential copyright infringement by a program called Krayon, which is bundled on the CDs.

Consequently, SuSE can continue to distribute its operating system SuSE Linux 7.3. The temporary injunction was brought by Crayon Vertriebs GmbH in Kiel, to inhibit any future potential dilution of market value of their brand "Crayon". The plaintiff felt that the copyright of their brand was infringed by the sale of the picture manipulation software "Krayon" advertised within the software product of SuSE Linux 7.3. Both parties today agreed to an out of court settlement. The plaintiff relinquished their right as formulated in the temporary injunction, and SuSE GmbH was not required to submit payment for any license fees.
