I did some patches in that area after 12.3 GM, I also added support for
overlayfs which I hope will work more reliable when it comes to persistent
writing. Due to the new isohybrid we also get the partition devices back thus
only the partition and not the entire disk is in busy state which is the main
reason for the problem you stumbled over here

I also plan to support persistent writing into a cow file instead of creating
a new partition on the device.

I'm closing this one as fixed now even thought there are a couple of new
stuff in the loop which references this feature.
The fix for the particular "busy" problem you got is fixed with
commit bda6d0e39afb0b2e9156865e52adab235709cfe1 from the kiwi master
branch, this was right after 12.3 GM, kiwi 5.5.1, we are now at 5.5.6
