Check for a lock file on the modem in /var/lock (i.e., /var/lock/LCK..ttyS1). If you're not using the modem and haven't in the last minute or so, find out which one of your telecom programs might not be letting go. Another possible route of investigation: are you using mgetty on that device? If you're not sure, ps ax | grep mgetty. If it IS running, try disabling it and see if the HylaFax server reports idle status on the modem. I've seen mgetty get in the way of HylaFax before, even when faxgetty wasn't running.
