Is there a reason FailSafe isn't included on the SuSE CDs?

Howdy, I've only just started looking into this, so this might be a really stupid question but I'm going to ask it anyway :-) Why isn't FailSafe included on the SuSE CDs (as a patched kernel and utill RPMs or whatever)? Is it for legal reasons?
