Well, in practical terms that's the case. There is a distinction between the reality or otherwise of deletion on the media and the *intent* to erase one's tracks. I may consider a file deleted while knowing it is still stored in physical terms. If someone trying to cover his tracks (or save his butt) is incognisant of the underlying reality that is a different matter.
