as so, I can't make a file system on it (disk mounted) and I can't umount it (nothing relies on it, but umount think it's used)
in fact it happended that the new (from repair shop) disk was broken (probably during travel). The brand new one I have now had no difficulty at all to be formatted (the new partition was not mounted) as ext3, and the new make of the ext2ifs driver supports ext3.
