Hallo Thorsten Haude, die Antwort ist nicht korrket!! Im Falle von konkreten Hinweisen z.B. auf eine Straftat, . Industriespionage u.s.w. ist eine Überwachung einzelner Account zulässig. Es darf keine allgemeine, generelle Überwachung bzw Auswertung geben. Sinnvoll sind Betriebsvereinbarungen oder sonstige schriftliche Vereinbarungen. Damit eindeutig geregelt ist, was zulässing oder nicht. So wie ein Arbeitgeber auch einen Detektiv einsetzen darf, wenn ein Arbeitnehmer während des Urlaubs oder Krankheit für Dritte arbeitet. Im Falle eines Prozesses muß das Unternehmen selbstverständlich die Notwendigkeit nachweisen. Die Anforderungen dafür hoch sind, aber ein Unternehmen muß es nicht zulassen, daß das Firmen eigene Mailsystem mißbräulich genutzt wird. Die Frage ist, wenn einem, als Sysadmin, ein solches Ansinnen angetragen wird, ist das ein Grund für eine fristlose Kündigung des Arbeitsvertrags, seitens des Arbeitnehmers, also des Sysadmins? Ich hätte keine Lust, bei so einem Verein noch eine Minute länger zu arbeiten. Oops, falsch gelesen. Das ist schon interessanter. Du kannst aber praktisch auch gleich zur Staatsanwaltschaft gehen, falls es zu einem Prozeß vor dem Arbeitsgericht kommt. Ich kann mir nicht vorstellen, daß Dein Chef Dir Schwierigkeiten machen würde.

Ich möchte ein bisschen bremsen: Es ist nicht grundsätzlich so, dass der Arbeitgeber die Mails der Angestellten nicht kontrollieren darf. Erst mal ist die Frage, ob dem Arbeitnehmer die private Nutzung des diesnstlichen Mail-Accounts gestattet wurde. Wenn nicht gibt es viel weniger Gründe die dagegen sprechen, dass der Arbeitgeber die "Dienstpost" auch kontrollieren kann - speziell dann nicht wenn er begründeten Verdacht hat, dass der Arbeitnehmer da Schmuh betreibt. Auch der Arbeitgeber hat durchaus berechtigte Interessen, die man nicht generell als "böse" oder "Verfassungsbruch" abtuen sollte. Was zum Beispiel, wenn unter den Kollegen bekannt wird, dass ein Kollege Geschäftsgeheimnisse an die Konkurenz verkauft? Die Geschäftsleitung erfährt davon. Ist es dann böse oder gar Verfassungsbruch, wenn Sie die Mail des Arbeitnehmers kontrolliert? Was sicher nicht geht ist eine pro-forma Überwachung aller Mails durch den Arbeitgeber. Und was würde ich von einem Arbeitgeber halten, der beispielsweise meinen Spind öffnet? Wenn es einen Verdacht gibt, ist das Arbeitsverhältniss ohnehin nur noch durch ein offenes Gespräch zu retten. Bitte nicht für mehr nehmen als es ist: meine Erinnerung an das, was ich zu diesem Thema gelesen habe (iX, c't, Linux-Magazin möglicherweise auch irgendwelche Jura-Blättchen wie NJW). Entscheidend ist, dass es dazu klare Regeln gibt. So einfach per BCC mitlesen (es sei denn das ist für alle Beteilgten erkennbar so geregelt) geht natürlich nicht.

Wir hatten mal einen Mitarbeiter, der immer teure Auslandsgespräche geführt hat (stundenlang nach Afrika). Der Mitarbeiter ist dafür sogar extra am Wochenende in die Firma gekommen. Von anderen Mitarbeitern darauf angesprochen hat er immer nur abgewiegelt ("mach dir mal keine Gedanken"). Der hat innerhalb einiger Wochen ca 5000 DM vertelefoniert. Hatte der Arbeitgeber das Recht sich die Logs der Telefonanlage anzuschauen? Was überwiegt da: der Schutz der Privatsphäre des Kollegen (immerhin konnte man in den Logs die Zielnummern sehen) oder das materielle Schutzbedürfnis des Arbeitgebers? Der damalige Chef hat die Sysadmins angewiesen die Logs der Telefonanlage auszuwerten. Ergebnis: der ferntelefonierende Mitarbeiter ist längste Zeit Mitarbeiter gewesen. Das ist etwas anderes. - die Logs angucken oder - die Gespräche mithören, da liegen Welten zwischen. Ich hätte überhaupt keine Probleme damit, die Maillogs zu checken, etwa wenn aus unserer Firma heraus Massenmails versandt würden. Über unsere Telefonlogs gucken wir auch grob drüber, ob da irgendwo was vierstelliges aufschlägt. Meines (Halb-)Wissens gibt es aber auch dort bestimmte Einschränkungen. So dürfen glaubich Telefonnummern wie "Anonyme Alkoholiker" oder "Telefonseelsorge" nur verstümmelt auftauchen. Aber soweit gucken wir eh nicht (solange eben nicht vierstellig...)
Was überwiegt da: der Schutz der Privatsphäre des Kollegen (immerhin konnte man in den Logs die Zielnummern sehen) oder das materielle Schutzbedürfnis des Arbeitgebers?
Die Privatsphäre. Genau deswegen darfst du die Gespräche nicht abhören. Daß du beim Telefonieren "Datenspuren" hinterlässt, die außerhalb deiner Kontrolle liegen, weißt du vorher, also ist das Log nicht "privat", somit kein Eingriff in gleichnamige Sphäre.

Deshalb sollte man sowas ja im EINZELFALL entscheiden. Erstmal feststellen, ob das "Abhören" der Mailaccouns in DIESEM KONKRETEN FALL überhaupt unberechtigt ist und um was es geht. Und dann entscheiden. Und nicht einfach so pauschal "sowas mache ich nicht, dann kündige ich halt eben". Nur, um das nochmal klarzustellen: Natürlich würde ich keine Straftat begehen, nur um meinen Arbeitsplatz zu behalten. Ich würde es einfach verweigern und warten, bis ich gekündigt werde; und dann gegen die Kündigung klagen. Daß manch einer nichtmal auf seinen Benz verzichtet, ist allerdings mehr als erbärmlich.

Das sieht man doch derzeit, was übrigbleibt, wenn sich Terrorismusbekämpfung, Jugendschutz, Geheimdienste und Kinderpornobekämpfung ihr Stück vom Kuchen abschneiden: Ich kann mir meiner eigenen Mails nicht sicher sein. Nicht der böse Hacker ist's, sondern Vater Staat und Mutter Arbeitgeber stecken ihre Nase rein. Wenn ein Arbeitgeber seinen Angestellten nicht traut, soll er sich von ihnen trennen. Wenn er sich von ihnen nicht trennen will, soll er ihnen trauen. Technik repariert keine sozialen Störungen. Ich finde diese ganze eMail-Kontrolliererei sowieso lächerlich. Ehrlich gesagt: Wenn Du in der Arbeit private Mails mit Deinem Firmenaccount schreibst, bist Du selber schuld. Ich finde es zwar nicht richtig, wenn der Arbeitgeber Mails kontrolliert aber leid tun kann mir keiner. Zum Thema Vater Staat: Es gibt eine sehr wirksame Methode, dafür zu sorgen, dass _keiner_ seine Mails liest: Verschlüsselung. Und die ist (gott sei dank) in Deutschland erlaubt.
