Hatte der Arbeitgeber das Recht sich die Logs der Telefonanlage anzuschauen?
Das ist etwas anderes. - die Logs angucken oder - die Gespräche mithören, da liegen Welten zwischen. Ich hätte überhaupt keine Probleme damit, die Maillogs zu checken, etwa wenn aus unserer Firma heraus Massenmails versandt würden. Über unsere Telefonlogs gucken wir auch grob drüber, ob da irgendwo was vierstelliges aufschlägt. Meines (Halb-)Wissens gibt es aber auch dort bestimmte Einschränkungen. So dürfen glaubich Telefonnummern wie "Anonyme Alkoholiker" oder "Telefonseelsorge" nur verstümmelt auftauchen. Aber soweit gucken wir eh nicht (solange eben nicht vierstellig...)
Was überwiegt da: der Schutz der Privatsphäre des Kollegen (immerhin konnte man in den Logs die Zielnummern sehen) oder das materielle Schutzbedürfnis des Arbeitgebers?
Die Privatsphäre. Genau deswegen darfst du die Gespräche nicht abhören. Daß du beim Telefonieren "Datenspuren" hinterlässt, die außerhalb deiner Kontrolle liegen, weißt du vorher, also ist das Log nicht "privat", somit kein Eingriff in gleichnamige Sphäre.
Der damalige Chef hat die Sysadmins angewiesen die Logs der Telefonanlage auszuwerten. Ergebnis: der ferntelefonierende Mitarbeiter ist längste Zeit Mitarbeiter gewesen.
