Was zum Beispiel, wenn unter den Kollegen bekannt wird, dass ein Kollege Geschäftsgeheimnisse an die Konkurenz verkauft? Die Geschäftsleitung erfährt davon. Ist es dann böse oder gar Verfassungsbruch, wenn Sie die Mail des Arbeitnehmers kontrolliert?
...und was ist, wenn der Verdacht falsch ist? Im Gegensatz zur "Taschenkontrolle" erfährt derjenige nichtmal was. Und was würde ich von einem Arbeitgeber halten, der beispielsweise meinen Spind öffnet? Wenn es einen Verdacht gibt, ist das Arbeitsverhältniss ohnehin nur noch durch ein offenes Gespräch zu retten. Und der Angestellte hat ein Recht darauf, zu erfahren, das es gegen ihn einen Verdacht gibt. Ich denke sowieso, nur ein Vollidiot klaut Firmengeheimnisse per eMail. Wie schnell landet sowas wegen eines Fehlers beim Admin. Wenn ich meinen Arbeitgeber Informationen klauen wollte, mache ich Ausdrucke/(Foto-)kopien und spazier damit zur Tür raus. Die Überprüfung meiner Mails via generellem Bcc kann aber sicherlich (nichtmal) juristischer Überprüfuing standhalten. Naja, und "juristisch" und "praktisch" sind zwei verschiedene Dinge.
