Auf keinen Fall kannst Du entlassen werden, weil Du ablehnst, eine Straftat zu begehen. Allerdings solltest Du in einer solchen Situation in jedem Fall einen Anwalt zu Rate ziehen.
Ich möchte ein bisschen bremsen: Es ist nicht grundsätzlich so, dass der Arbeitgeber die Mails der Angestellten nicht kontrollieren darf. Erst mal ist die Frage, ob dem Arbeitnehmer die private Nutzung des diesnstlichen Mail-Accounts gestattet wurde. Wenn nicht gibt es viel weniger Gründe die dagegen sprechen, dass der Arbeitgeber die "Dienstpost" auch kontrollieren kann - speziell dann nicht wenn er begründeten Verdacht hat, dass der Arbeitnehmer da Schmuh betreibt. Auch der Arbeitgeber hat durchaus berechtigte Interessen, die man nicht generell als "böse" oder "Verfassungsbruch" abtuen sollte. Was zum Beispiel, wenn unter den Kollegen bekannt wird, dass ein Kollege Geschäftsgeheimnisse an die Konkurenz verkauft? Die Geschäftsleitung erfährt davon. Ist es dann böse oder gar Verfassungsbruch, wenn Sie die Mail des Arbeitnehmers kontrolliert? Was sicher nicht geht ist eine pro-forma Überwachung aller Mails durch den Arbeitgeber.
