This is likely not true. If the respin uses only *openSUSE* packages (packages from the openSUSE: namespace), then that's probably the case. Other packages from OBS are just like any other repository and would not qualify for leveraging the openSUSE branding. We could probably make some carve-outs for linked devel projects, because they usually have Factory rules imposed on them too.

You are actually looking at the wrong wiki page https://en.opensuse.org/openSUSE:Trademark_guidelines has the needed info (it was written when SUSE studio was around and this process was much easier) But basically Neal is right in that using only things under the openSUSE namespace is essentially still openSUSE as it has undergone our code and legal reviews. Where as use of packages outside that namespace on obs or from outside (flatpak's, docker images, other rpm's) would mean that it is no longer a "Remix" of openSUSE, it is now a derivative distribution because it uses resources that are not part of the openSUSE project and under our current trademark guidelines would then need to be rebranded. As a hypothetical example (i'm not on the board I have no idea what triggered this discussion), say someone wanted to bring back "openSUSE Edu" if they submitted all there packages into Factory and or Backports they could then use kiwi (or other tools) to create a specific image with a curated set of packages called "openSUSE Edu". No, they don't.
