I'm running 3.3-rc2 from wireless-testing, and I do not see any panics without this patch. In addition, the commit message only talks about some warnings and not about a panic. There has been work on that driver in the past few days. Mainline 3.3-rc2 is a lot older. If you want the latest, either build the latest bleeding-edge compat-wireless, or pull the wireless-testing git tree. Either one is getting close to what will be in kernel 3.4.
