It's irrelevant with KMS or not. It's a matter whether kernel bootsplash or plymouth. (And "nearly every graphics chip" is not correct; it should be "nearly every graphics chip to be sold now" :)

Since 12.3, we have no longer theme for the kernel bootsplash, so a
.. and that confirms it. :)
pure 12.3 system doesn't use the feature at all. In that sense, we can drop the patch. But if you use 12.3 or later kernel on the old system (e.g. SLE11), the bootsplash can still work, though.
