If that's the intent, then zypper should be smart enough to uninstall the conflicting package (after asking if the user is OK with that). Leaving both packages installed after the conflict is OK'ed is a bug in this case, IMHO. Yes, but I thought it was already an established fact that kernel is a multiversion installable package and that means either all files installed by such packages must include the build number or must never be re-built at all. The file names recently were changed to include the patch level for that very reason.
