Just check if everything you want to do with the device works with the default (in-kernel) driver. If something does not work with it, try if it works with the out-of-tree driver you found. If it works there, create a bug report with the linux-wireless developers. You could also try to compare the performance of both drivers (better network throughput for example) and report on that.
