In other words if we pack the non-OSS stuff on the same media you wouldn't be allowed to pass the DVD to your friend or your neighbor. I fully agree with your point - it would be more convenient having one media. From a legal perspective, putting non-oss packages on the retail DVD would mean

The fact that the DVD9 retail DVDs are technically not easy to copy (because of the cost of blank media) is not relevant here - we are talking about legal restrictions on copying, not technical restrictions. You point out that people will most probably use the downloadable DVD for copying. If no-one will ever copy the release DVD9 then those legal issues for the DVD-copy-ability simply will not apply; don`t we already agree? This is an assumption.

In the past we were contacted on numerous occasions by (e.g.) magazines wishing to distribute openSUSE but failing because of the proprietary software. I have explained the legal perspective above.
