The rfkill module is bound to the cfg80211 now as opposite to the 2.6.27 [2]. This change is only a part of the upstream effort to unify the wireless extension into the nl80211 [3] . nl80211 and cfg80211 are still under development. You should expect the wireless (and bluetooth for that matter) to remember it's previous state when rebooting. If turn it off then reboot I expect it to be off and vise-versa. I don't think this is a major bug but it's a big annoyance.
