No, it looks properly escaped when I see this cmdline. Here really looks like problem with opening /dev/tty.
Does this device exists on given system?
I'm not sure if I fully got the question, but /dev/tty is reflecting Current TTY device. If that works properly, I tried echo "123" > /dev/tty and got that on currently selected tty, so works fine. Also, as David has helped us to find, it's easy to reproduce on qemu, but not on virtualbox, for example.
