Hmm, I had a look at home last night, but there isn't a thermal_zone in my /proc/acpi :(. Did your installation automatically configure this, did you have to manually load the thermal module, or have I just missed a section in Yast? I'll investigate the thermal_zone over the weekend and report back. I notice that CPU throttling works nicely, so I'd be amazed if the temperature really is a constant 40 C.
