I hardly can say that it is Nvidia who distributes them after reading this
notice.
Also I wonder why an Independent Hardware (or Software) Vendor (such as
Bumblebee Project)
cannot distribute them via OBS.

You are wrong, they are NOT built on public openSUSE Build Service
instance.
Files ARE prepared on public OBS but building is done on build.suse.de
So how does it affect copyright? If you build something on another server
it saves you from copyright violation?
Distribution of the built RPMs is the key here.
We do not distribute them, the IHV (Independend Hardware Vendor) does.
