It actually just talks about SUSE Linux Enterprise Server, but I think it´s counting for openSUSE as well. So, if you´re promoting openSUSE to some kind of patent paranoids, you can use this to convince them about openSUSE and Linux :-)
The patent side is really not the big part of the deal, it's about interoperability and selling - making customers happy and earning money for SUSE ;).
