As I understand it GNU is the lead organization setting the standards for
Linux.
If I remember quickly they created GPL so it is for them to defend and
all users and developers should help. As it stands the suit would first
need to be brought in America where there is a principle called "Conduct
of Partys" which goes back to european common law. Basically if users
here and abroad agree, by their conduct that GPL is lawful it is until
legislative act changes it.
I dont know if this principle exists outside Europe & the united States.
It could be argued logically to be a basic principle of law so basic
infact as to be a founding principle perhaps differently stated in almost
any legal code in any nation.
Perhaps someone could check Blacks Law or Bouvies(sp?).
Lets hope it does not come to this because it could harm us more
financially than it would harm SCO / M$.

Actually, Linus sets the standards for Linux. The FSF is an umbrella organization that authors can assign ownership of their GPL'd code to. The rationale being that the FSF as a whole will be in a better position to defend the GPL (when such a suit comes up) than individual authors. That's a very cursory explanation.
