No, that file is created automatically and I would very be surprised if it wasn't present before the upgrade. I certainly have it on my 12.3 systems.
My upgrade test was done on a virtualized system, on vmplayer.
Ah, I see - yes, I just checked a xen instance, 70-persistent-net.rules is empty there too, presumably because it doesn't have any real hardware.
