As I understand the workings of FreeDB and CDDB, a "signature" fragment of the CD's raw data is sent as a key to look up album information. Thus you cannot retrieve album information without disclosing the fact that you have a particular CD. I'm sure some consider that a breach, but as Matthias said, you don't have to use it if you don't want to let anyone know what CDs you possess.
