Yes, you need a kernel with cgroups enabled.

But that's not a dependency between systemd and the use of cgroups. As
in - I can use cgroups without using systemd.

Of course you can. And should. But it is all much more natural if all
services are put into their respective group from the start (that's what
systemd does) than if you have to "reclassify" after they are started
(that's what you can do now).
