And when installing the guest additions in Windows it asks for a License
agreement with the PUEL so that tells me that we can't redistribute the iso.

Read Section 2.2 of the license. Then read comment #6 above.
The assumption that it is possible redistribute the guest additions for
openSUSE is based on:
(1). the (re)distribution is of unmodified guest additions
(2). the (re)distribution can be done independent of Sun's VirtualBox PUEL
(i.e. the guest additions iso is a separate image

It doesn't surprise me that end users are asked to agree to the PUEL on
installation of the guest additions. By way of comparison, for openSUSE, Novell
is allowed to redistribute Adobe Acrobat - yet the End User is still asked to
agree to a EULA on installation/first run. This is quite commonplace for
proprietary software.
