A clean way to solve this would be to change kexec to reserve also memory in the DMA region just for DMA. But that would need a change in the kernel and in the kexec userspace tool. Changing a interface between kernel and userspace requires (at least IMO) upstream integration and cannot be patched into SP1. I try to propose a solution upstream, but it's not possible to integrate this into SP1 in a decent timeframe (we cannot make such changes in RC phase).
