I found the issue. The Kernel is fine and the cause is the user in an extreme case of PEBCAK :/. I have a long USB extension cable conntected to my laptop and to which I connect a small USB-A to USB-C cable, to which I connect my Android device for development. Believe it or not but I had plug that USB-A to USB-C cable wrong (that is the terminal USB-C end connected to the USB-A). It resulted in the Kernel thinking there is a USB device connected somehow, making suspend fail.
