The Ubuntu Foundation is not a Foundation like the one we want to create. To summarize things bluntly: at the moment, it's merely a bank account with lots of money to make sure that the Ubuntu project can survive for some time if Canonical/Mark decides to stop investing in the Ubuntu project. There's is no real/formal not-for-profit organization for Ubuntu (except all the small ones for local groups).
