yes, it was already discussed in past. It is intention that bootloader allows to install stage1 to more locations, so e.g. when something ( like different bootloader overwrite MBR, still stage1 from partition can be used ( e.g. for chainloading ). Regarding active flag. It is set of various checks which in the end decide if it is proposed to activate flag or not. So it is not that by default it is proposed or not, but it depends on various conditions like if there is already boot flag, if generic MBR is written or if we are on ppc64. So for me it is more like feature, that need to be precise discussed what we want to achieve and if it is OK, to drop some work-flows.
