understand there's no clear meaning in "IP" as it tends to be used
everywhere for all kinds of completely different law tricks. Sometimes
they talk about copyright and call it IP, sometimes they talk about
usual ("hardware") patents and call it IP.

Are you talking about software patents here? Does Novell really need
to care about it as they're unenforceable in every sane jurisdiction?

I'm talking about all kinds of IP here. Patents, 3rd party code, own
business important knowledge, differentiation from competitors, NDAs
with technology owners, you name it.

With the opinion that they are unenforceable you are pretty much on
your own. The opposite is the case, even in Germany where we ought to
not have software patents, but do have.
