Perhaps we need to focus on that rather than on the 'top end', the ACL and the spawning. There are two ways that this can come about. a) the rsyncd is in fact not doing an exit but instead going into a listening loop b) the rysncd is in fact exiting but the 'zombie' is not being cleaned up.
