Ah, I see - yes, I just checked a xen instance, 70-persistent-net.rules is empty there too, presumably because it doesn't have any real hardware. I guess we're back to that it wasn't tested (where it matters, on real hardware).
I tested it in qemu with explicit MAC that is not ignored. First installed 12.3, then all updates (you need updates because stock 12.3 dropped support for persistent interface legacy names and it was added back as update). Verified that 70-persistent-net.rules was present and contained correct information. Updated to 13.1 (using offline method for a change). After reboot in 13.1 70-persistent-net.rules remained and interface name was eth0 as before.
