I would suggest the NET cd as you will do less downloading in-the-long-run.
Downloading a DVD should be no problem.
If it was really factory you were looking for: http://download.opensuse.org/factory/iso/openSUSE-NET-x86_64-Build0370-Media...

Yes, with the NET CDs it is necessary to be online, but you have to "be online" to download the DVDs, also...... You have indicated you experience problems with the "build0039" DVD, the NET CD or the "LiveCD" quite possibly may not have "problems". Personally, I had no problems installing 12.1 and soon after adopted Tumbleweed. I would install a newer issue, ie: 12.2, or even 12.3-beta1.
